1. Who we are
Nearby Notify is a service operated by [OPERATOR LEGAL NAME] ("we", "us"). This policy describes how we handle personal information in connection with our website and application (the "Service"). It should be read together with our Terms of Service.
2. Two roles: our customers, and their subscribers
Account information belongs to the businesses and people who sign up for Nearby Notify. For that information, we act as the controller.
Subscriber Data is the information our customers collect about their own subscribers — the people who join a business's list. For that information, the customer is the controller and we are their processor: we store and process it only to provide the Service, on the customer's instructions. If you are a subscriber to a business that uses Nearby Notify and you have questions about your data or want it removed, please contact that business directly; you can also unsubscribe from any message they send (see Section 10).
3. What we collect
From our customers (account holders)
- Account details — name, business name, email address, password (stored only as a salted hash, never in plain text), time zone, and settings.
- Billing details — plan, subscription status, and the last four digits and card brand as reported by our payment processor. We do not store your full card number; card data is handled directly by Stripe.
- Connected accounts — credentials you choose to connect (such as a texting account) are stored encrypted and used only to send on your behalf.
- Usage and technical data — log data such as IP address, actions taken in the app, timestamps, and error information, used to run and secure the Service.
Subscriber Data (on behalf of our customers)
- Subscriber names, email addresses, phone numbers, city and postal code, opt-in choices, and message history (such as sends, opens, clicks, replies, bounces, and unsubscribes). This is provided or collected by our customers, who are responsible for having the right to do so.
4. How we use information
- to provide, maintain, secure, and improve the Service;
- to send the Messages our customers direct, and to record delivery results;
- to process payments and manage subscriptions;
- to protect against fraud, abuse, and threats to deliverability or security;
- to communicate with customers about their account and the Service;
- to comply with law and enforce our Terms.
We do not sell personal information, and we do not use Subscriber Data for our own marketing.
5. AI-assisted features
Some features use a third-party AI provider (Google) to generate suggested message content or replies from the information you provide, such as what you type and details about your business. That information is sent to the provider to produce the suggestion. We do not send your full subscriber list for this purpose. AI output is a draft for you to review; see our Terms for the limits on it.
6. Service providers we rely on
We share information with vendors who process it on our behalf, under contracts that limit their use of it. They currently include:
- Railway — application hosting and database.
- Cloudflare — domain and network services.
- Stripe — payment processing (handles card data directly).
- Amazon Web Services (SES) — email delivery.
- Twilio or a similar provider you connect — text-message delivery, under your own account.
- Google — the AI features described in Section 5.
These providers may change; we will keep this list reasonably current.
7. When we share information
Besides the providers above, we may disclose information: to comply with law, legal process, or a valid government request; to enforce our Terms or protect the rights, safety, or property of Nearby Notify, our customers, or others; and in connection with a merger, acquisition, financing, or sale of assets, in which case we will require the recipient to honor this policy. We do not otherwise sell or rent personal information.
8. How long we keep it
We keep account and Subscriber Data for as long as the account is active and as needed to provide the Service. After an account is closed, we may retain data for a reasonable period to allow export and to meet legal, accounting, and security obligations, after which we delete or de-identify it. Customers can delete subscribers and content within the app at any time.
9. How we protect it
We use technical and organizational measures designed to protect information, including encryption in transit (TLS), encryption at rest for stored credentials, database-level isolation between customers so one account cannot read another's data, hashed passwords, and access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your password confidential.
10. Subscribers and opting out
Every marketing email sent through the Service includes a one-click unsubscribe link, and text recipients can reply STOP to opt out. Opt-outs are recorded and honored automatically. If you are a subscriber and want your information corrected or removed, contact the business whose list you joined; as their processor, we will assist that business in fulfilling your request.
11. Your rights
Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, and to object to or restrict certain processing. Account holders can access and export much of their data directly in the app. To make a request, contact us at the address in Section 16. For Subscriber Data, we will refer or assist as processor for the relevant customer. We will not discriminate against you for exercising these rights.
12. U.S. state privacy rights
Residents of Colorado, California, and other states with privacy laws may have the rights described above, including the right to opt out of the "sale" or "sharing" of personal information and of targeted advertising. We do not sell personal information or use it for cross-context behavioral advertising. You may exercise applicable rights by contacting us; we may need to verify your identity first.
13. Children
The Service is for businesses and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us information, contact us and we will delete it.
14. Where information is processed
We operate in the United States, and information is processed there. If you access the Service from outside the United States, you understand that your information will be processed in the U.S., where privacy laws may differ from those in your location.
15. Changes to this policy
We may update this policy from time to time. We will change the date above and, for material changes, provide additional notice where appropriate. Your continued use of the Service after an update means you accept it.
